On October IS, 2004, Complaint Counsel, pursuant to Rule 3. 34(a)(2) oftbe Commission s Rules of Practice, filed a third motion for the issuance of an additional seven subpoenas commanding persons to attend and give testimony at the adjudicative hearing in this matter. The motion, which references Complaint Counsel's final witness list, provides a brief description of the intended testimony of each individual. Complaint Counsel has represented that the individuals are on Complaint Counsel' s final witness list and that the individuals are located in the United States. Respondent does not oppose Complaint Counsel's motion.
