Introduction: This comment urges the Commission to clarify a number of issues raised by its recent enforcement actions challenging pharmaceutical patent settlements. The Commission?s press release recognizes that ?the appropriate parameters of permissible conduct in this area? are now uncertain and that ?there may be market settings in which similar but less restrictive arrangements could be justified.? Accordingly, the Commission has invited wide-ranging comment on the subject of patent settlement agreements.
