Excerpt: The Administration has significant concerns about S. 2359, which we consider to be a highly controversial provision related to U.S. Customs ', enforcement of trademarks and the ' . longstanding debate over permitting imports of grey-market goods. Under U.S. Customs Service regulations, certain U.S. trademarks are not enforced at the border, i.e, importation is permitted without the authorization of the trademark owner. Currently, this exception covers U.S. trademarks if there is common ownership or control between a foreign owner of the trademark registered in another country and the U.S. owner of the U.S. registered trademark. This bill would broaden that exception. Some have questioned the consistency of the current regulations with U. S . obligations under the Agreement on Trade-Related Aspects of Intellectual Property Rights and the General Agreement on Tariffs and Trade 1994. Exempting additional, but not all, trademarks from enforcement would exacerbate this problem.
