Excerpt: Definitions. ?Software? means (a) all of the contents of the files, disk(s), CD-ROM(s) or other media with which this Agreement is provided, including but not limited to (i) Adobe or third party computer information or software and (ii) related explanatory written materials or files (?Documentation?); and (b) upgrades, modified versions, updates, additions, and copies of the Software, if any, licensed to you by Adobe (collectively, ?Updates?). ?Use? or ?Using? means to access, install, download, copy or otherwise benefit from using the functionality of the Software in accordance with the Documentation and the terms and conditions of this Agreement. ?Computer? means an electronic device that accepts information in digital or similar form and manipulates it for a specific result based on a sequence of instructions. ?Content? means an electronic digital file in the form of an eBook or other similar electronic file. ?Gateway? means a destination, public or private, used for accessing a specific set of Content in an environment where Transactions occur, including but not limited to an electronic storefront, corporate library, or an intranet. ?Transaction? means the sale, license, lease, gift or other distribution involving Content. ?Activate?, ?Activated? or ?Activation? means the distribution of a single Content file to a specified address pursuant to a valid Transaction. ?Adobe? means Adobe Systems Incorporated.
